Terms of Service

1. Agreement

These Terms of Service ("Terms") are entered into between you and XAIQUOTE LTD, a company operating as XaiQuote ("XaiQuote," "we," "us," or "our"). By accessing or using XaiQuote's assessment infrastructure platform, APIs, and services, you agree to these Terms. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.

2. Services

XaiQuote provides cloud-based simulation engines, APIs, white-label dashboards, and related tools for skill evaluation platforms. Services are provided as described in your plan and our documentation. We reserve the right to modify features with reasonable notice.

3. Account and Payment

You must provide accurate account information and keep it current. Subscription fees are billed in advance. Payments are processed through our payment provider(s). You authorize us to charge your chosen payment method for recurring fees. Refunds are handled per our refund policy. Unpaid accounts may be suspended. By using our payment services, you also agree to the terms of our payment provider(s) where applicable.

4. Acceptable Use

You agree not to use our services to:

• Violate laws or infringe on others' rights.
• Distribute malware, spam, or harmful content.
• Circumvent security controls or abuse rate limits.
• Resell or sublicense without authorization.

We may suspend or terminate accounts that violate these terms.

5. Intellectual Property

XaiQuote retains all rights to our platform, APIs, and content. You retain rights to your data and content. We may use anonymized usage data to improve our services. By using our APIs, you grant us a limited license to process your data as necessary to provide the services.

6. Limitation of Liability

Our services are provided "as is." To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages. Our total liability is limited to the fees you paid in the 12 months preceding the claim.

7. Termination

You may cancel your account at any time. We may terminate or suspend access for breach of terms or for business reasons with notice. Upon termination, your right to use the services ceases. We may retain data as required by law or our Privacy Policy.

8. Changes

We may update these terms. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.
